Adrian, MI – The fate of the City of Adrian Point of Sale Ordinance will be in the hands of the voters. The Adrian City Commission recently made a decision whether or not to repeal the Ordinance or put the matter up to the voters of the city due to a successful referendum petition to repeal the ordinance.
There were two resolutions on the recent agenda…one with each option. The Commission voted, 5-2, to place the matter before the voters at the next election.
With that resolution passing, the fees required by the Point of Sale Ordinance will not be assessed until such time as the ordinance may be confirmed by a vote.
Prior to that resolution’s approval, an amendment was offered by Commissioner Robert (Bob) Behnke…to freeze the Point of Sale enforcement until the next election. Behnke, Mary Roberts and Mayor Angie Heath voted in favor of that amendment.
Commissioners Douglas Miller, Kelly Castleberry, Gordon Gauss, and Matthew Schwartz voted against the amendment.
The original resolution, to waive fees until a vote of the City of Adrian electorate, passed. Commissioners Castleberry, Miller, Schwartz, Roberts and Gauss voted in favor. Mayor Heath and Commissioner Behnke voted against.
Even with fees waived until the vote, the Point of Sale Ordinance will go into effect in the City of Adrian on November 30th. Depending on the results of the vote, the ordinance could stay, or be repealed. The ordinance, as adopted, is posted below in the minutes from June 3rd, 2024 meeting (beginning on page 62)
