
Adrian, MI – Lenawee County Circuit Court Judge Michael Olsaver has set a pretrial date for Dale Warner, the Lenawee County man charged with murdering his wife, Dee Warner. There was a brief pretrial conference Wednesday morning between the Judge, the Prosecutor, and the Defense Council to set a date for the pretrial.
Lenawee County Prosecutor Jacqueline Wyse was representing The People, and Mary Chartier was representing Dale Warner. Chartier told Judge Olsaver that she had ordered the preliminary examination transcripts from District Court, and that the staff is halfway through the process. She also talked about both sides being proactive in the discovery phase of the case. Prosecutor Wyse had nothing to add at the pretrial conference Wednesday.
Judge Olsaver addressed one issue previously discussed off record. It was regarding his assignment to this case. He said that he has previously disqualified himself from preliminary examination stage in order to avoid “even the slighted appearance of any impropriety” because at that stage of the case, his role would have included making factual findings. Judge Olsaver disclosed that he has been assigned to other cases involving Dale Warner, including a civil case.
Judge Olsaver had reviewed a number of search warrants related to this case. He said that he does not believe that his assignment in this case would create an issue with impropriety. He said that if the parties believe there is reason to disqualify him, they may file a motion to do so.
A pretrial date was set for Wednesday, September 4th at 8:15am.
