Dee Warner Declaration of Death Trial Begins in Lenawee County Probate Court

Adrian, MI – It will take more than one full day in Probate Court to determine whether a missing Lenawee County woman can be legally considered dead. It has been over two years since Dee Warner went missing from her Munger Road home…and the family is now working to have her legally declared dead.

Typically in Michigan, a person can legally be considered dead after 5 years of being missing. The legal team petitioning to have her declared dead called several witnesses to the stand, to attempt to paint a picture of who Dee was…and that she would never leave her children or grandchildren.

Probate Judge Catherine Sala heard testimony from the woman who saw Dee on April 24th, 2021… the day before she was officially considered missing. She also heard from a close friend of Dee’s…Dee’s massage therapist…an Intelligence Analyst with the First District of the Michigan State Police…the Conservator for Dee…and a handwriting expert.

The petitioning attorney for the family, Todd Flood, told WLEN News after the trial Tuesday that: “The facts spoke for themselves today. If you didn’t have emotion, you don’t have a soul.”

Larry Lieb, the attorney for Dee’s husband, Dale Warner, said: “I think things went well. We’ll have to see what the rest of the evidence shows. The judge will make a decision when the time comes.”

There was not enough time Tuesday to finish the declaration of death trial. A follow-up date has been set for August 16th.
