The penalty phase in the Sierah Joughin murder case will delayed until Tuesday.

Lawyers for convicted killer James Worley asked for a continuance Monday afternoon after saying one witness did not show up and a report arrived late to the defense lawyers.

13 abc reports that sentencing is expected to begin Tuesday morning.

A jury convicted Worley of capital murder last week in the 2016 death of Joughin, a University of Toledo student.

Worley faces the death penalty in this case.
